Terms of Service

1. Acceptance of Terms

By booking photography services with A.Sebastian Photo LV (“Photographer”, “we”, “us”, “our”) or by accessing the online gallery at https://gallery.a-sebastian-photo-lv.com, you (“Client”, “you”, “User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use our services or view the gallery.

2. Services Provided

Photography Sessions: Planning, shooting, editing, and delivery of digital images as agreed in the client contract or quotation.

Online Gallery Access: Hosting of selected images on a password‑protected or public web page for viewing, commenting, and downloading (subject to Section 5).

All services are provided on an “as‑is” basis unless expressly stated otherwise in a written agreement.

3. Booking, Payments, and Refunds

  1. Booking – A written estimate or contract must be signed before any work begins.

  2. Payments – A deposit of 50 % of the total fee is due upon signing; the balance is due on delivery of the final images or as otherwise specified. Payments are processed through third‑party providers (e.g., Stripe).

  3. Refunds – Deposits are non‑refundable except in cases of Photographer cancellation or mutual agreement. Refunds for completed work are at the Photographer’s discretion.

4. Client Obligations

  • Provide accurate contact information and any necessary permissions (model releases, location permits).

  • Cooperate with scheduling and preparation for shoots.

  • Notify us promptly of any issues with delivered images.

5. Gallery Use & Restrictions

  1. Access – Clients receive a unique link/password to view their private gallery; public galleries are accessible to anyone with the URL.

  2. Permitted Actions – You may view, share the gallery link with designated persons, and download images that you have been granted permission to download (e.g., high‑resolution files included in your package).

  3. Prohibited Conduct – You may not:

    • Reproduce, distribute, sell, or create derivative works from images without explicit written permission.

    • Use automated tools to scrape or bulk‑download gallery content.

    • Post images in a manner that violates privacy rights, defames, or infringes third‑party copyrights.

  4. Termination of Access – We reserve the right to suspend or terminate gallery access for breach of these rules, non‑payment, or unlawful activity.

6. Intellectual Property

  • Ownership – All photographs remain the exclusive intellectual property of the Photographer unless a separate license is granted in writing.

  • License Grant – Upon full payment, the Photographer grants the Client a personal, non‑commercial, worldwide license to use the delivered images for the purposes described in the contract (e.g., personal prints, social media sharing). Commercial use requires an additional license and fee.

7. Privacy

Your use of our services is also governed by our Privacy Policy (see separate document). By accepting these Terms you also consent to the data practices described therein.

8. Limitation of Liability

  • To the maximum extent permitted by law, the Photographer shall not be liable for indirect, incidental, consequential, or punitive damages arising out of or related to the services or gallery access.

  • Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Photographer and its affiliates from any claims, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the gallery.

10. Termination

Either party may terminate the agreement for cause with written notice. Upon termination, all outstanding fees become immediately due, and any licensed rights to use the images cease, except for any portions already delivered and paid for.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of Las Vegas, Nevada without regard to conflict‑of‑law principles. Any dispute shall be resolved through good‑faith negotiation; if unresolved, the parties consent to the exclusive jurisdiction of the courts located in Las Vegas, Nevada.

12. Modifications

We may revise these Terms at any time. Revised Terms will be posted on our website with an updated “Effective Date.” Continued use of our services after such posting constitutes acceptance of the new terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
